SEC WILL DECIDE ELECTION DATE

The legal opinion on the panchayat election process with regard to reservation has been set to the governed by the Attorney General Devidas Pangam.



 In the hlgal opinion Pangam states that the data which the State Election Commission currently possesses on OBC reservations for the upcoming Panchayat polls, is not as per Supreme Court directions.

The final election date will be decided by SEC in consultation with the state govt after the process of reservation is wards completed, the AG said.

 The AG said that he had given his opinion to this effect to the state government and sent the related file back to the government yesterday. The SEC had submitted reservation of wards for SC &ST to the govt and asked if the information presently available with them on OBC reservation was as per the directions of the Supreme Court or not. The govt had sent the file to AG seeking his opinion in the matter.

AG said

-To conform to the triple test as mandated by the SC, the State OBC commission will have to prepare a detailed report about the wards to be reserved for OBC

-As state already has basic population data, the same can be used to prepare report

-Report will have to be sent to the SEC

-SEC will do the final reservation by analyzing the data, applying it in reservation process

-The triple test says that the reserved should not exceed 50 % of the total seats

- SC/ST reservation is mandatory as per the constitution

-But same does not apply to OBC reservation

- As per the Panchayat Raj Act OBC reservation is mandatory, & can be decided upon by the govt

- As per the SC directions, henceforth reservation for all the panchayat, municipality elections will have to conform to triple test
