SC stays triple talaq for 6 months, ball in Govt court

The Supreme Court by a majority verdict stayed the practice of divorce through Triple Talaq on Tuesday for 6 months.



Calling the practice as void, illegal and unconstitutional it asked the government to formulate a law to govern this practice.  

The apex court by 3:2 verdict held that the triple talaq was against the basic tenets of the Koran.

Three of the five judges hearing the case said it is unconstitutional, the other two wanted it banned for six months till the government introduces new legislation.

The majority opinion held that triple talaq "is not integral to religious practice and violates constitutional morality".

Certain sections of the Muslim community had approached the Supreme Court  demanding that this practise be abolished or regulated arguing that it was against women.

The verdict was delivered by a panel of five judges from different major faiths - Hinduism, Christianity, Islam, Sikhism and Zoroastrianism.

This decision was welcomed by women’s activists in the state. Auda Viegas of Bailacho ekvot says that they were getting at least 2-3 cases per month of Muslim women being divorced through triple talaq.
